1. TERMS & CONDITIONS OF SALE

1.1 Introduction

• MJSTK Collectables (“we”, “us”, “our”) is a small family-run business based in NSW, Australia. By purchasing from our website, marketplace, live shows, or through any direct sale, you agree to the following terms.

1.2 Product Condition & Photos

• All single cards, sealed products, and accessories are sold as is. 
• Photographs form the primary basis of item condition, and buyers should rely principally on the images provided. 
• Additional written descriptions may accompany a listing, but the photos take priority in assessing condition. 
• Visual inspections are subjective and do not guarantee any specific grade from third-party grading services. 
• Normal manufacturing imperfections such as minor print lines, centring issues, surface specks, or small edge whitening are considered acceptable variations.
   

1.3 All Sales are Final

• All purchases are strictly final sale. 
• No returns, refunds, exchanges, cancellations, or change-of-mind requests will be accepted. 
• This includes sealed boxes, singles, breaks, mystery lots, and low-value items. 
• Refunds will only occur in situations required by Australian Consumer Law (ACL).
   

1.4 Australian Consumer Law

• We comply with our obligations under the ACL. A refund or replacement will be issued only when an item is:
• Not as described 
• Incorrect 
• Misrepresented in a significant way 
• This does not apply to grading disputes, subjective condition disagreements, or buyer remorse.

1.5 Photos & Descriptions

• Buyers must review all images prior to purchase. 
• Photos form the majority basis of the condition assessment. 
• Colours may vary between screens. 
• Written descriptions, if provided, are supplementary.
   

1.6 Orders, Payments & Chargeback Protection

• Orders are accepted once payment is received. 
• We reserve the right to cancel an order for stock errors, payment issues, or suspected fraudulent activity.
   

1.7 Chargeback Protection Statement

• By making a purchase through MJSTK Collectables (including website, marketplace, eBay, social media, or direct invoice), the buyer agrees:
• No chargeback or payment dispute will be initiated for reasons relating to: 
• Condition of the card where photos were provided 
• Grading outcomes or expectations 
• Change of mind 
• Delays caused by postal services 
• Low or zero-value hits in breaks 
• Chargebacks lodged contrary to these terms may result in: 
• Suspension from future purchases 
• Submission of evidence to the payment processor 
• Recovery of losses through appropriate dispute channels 
• We maintain extensive proof of: 
• Item photos 
• Packaging 
• Address labels 
• Postage receipts 
• Communications and confirmations

1.8 Pricing

• Prices are listed in AUD unless stated otherwise. 
• Prices may change at any time before checkout is completed.
   

2. SHIPPING POLICY

2.1 Processing Time

• Orders typically ship within 1–3 business days unless otherwise noted.

2.2 Tracked & Untracked Shipping

• Shipping options may include tracked and untracked methods. 
• Untracked shipping is offered for low-value single cards or specific buyer requests. 
• If a buyer selects untracked shipping, they accept full responsibility for any loss, delay, or non-delivery.
   

      Risk Transfer

• For tracked parcels: risk transfers upon carrier’s status of “delivered”. 
• For untracked parcels: risk transfers upon drop-off with the postal service.
   

2.3 International Shipping

• All international orders require an agreed shipping quote prior to sale finalisation. 
• No international sale will be completed without prior confirmation in writing. 
• Buyers are responsible for all import duties, customs taxes, or delays.
   

2.4 Packaging

• Cards may be shipped in:
• Toploaders 
• Sleeves 
• Team bags 
• Graded bags 
• Bubble mailers 
• Cardboard mailers 
• Boxes 
• Packaging is selected based on item type and shipping method.

3. WARRANTY EXCLUSION

• Trading cards, sealed products, and collectibles do not carry warranties. Manufacturer defects, odds variations, or QC issues are not covered by MJSTK Collectables.

4. RETURNS & REFUNDS POLICY

4.1 No Returns

• We do not accept returns under any circumstance except those mandated by Australian law.

4.2 Reporting an Issue

• If an item is received that is:
• Incorrect, 
• Significantly not as described, 
• Missing from the order 
• The buyer must notify us within 48 hours of delivery, including clear photographic or video evidence.

4.3 Excluded Situations

• Refunds are not issued for:
• Grading outcomes 
• Disagreement with subjective condition opinions 
• Manufacture-inherent variances 
• Delivery delays 
• Damage caused by the buyer 
• Items purchased via untracked post that do not arrive
   

5. COMMUNITY MARKETPLACE / HUB TERMS

• This applies to the MJSTK Marketplace or Community Hub where users can buy, sell, or trade.

5.1 Platform Role

• MJSTK Collectables acts solely as a platform provider. 
• We are not the seller, buyer, or intermediary unless explicitly stated. 
• All transactions are between the participating users. 

5.2 Liability Waiver

• MJSTK Collectables is not responsible for:
• Item authenticity 
• Condition disputes 
• Payment issues between users 
• Lost mail between users 
• Misrepresentation by users 
• Scams, dishonesty, or failure to complete a deal 
• Users participate at their own risk.

5.3 User Conduct

• Users must:
• Describe items accurately 
• Provide clear photos 
• Honour agreed deals 
• Not harass or defraud other users 
• Follow Australian law 
• We may suspend or remove users for misconduct at our discretion.

5.4 Fees

• If the platform charges listing or transaction fees, these will be disclosed separately.

6. DISPUTE HANDLING PROCESS

6.1 MJSTK Purchases

• For disputes involving MJSTK directly:
• Buyer contacts us with clear details and photos within 48 hours. 
• We review the submission within 1–3 business days. 
• If the issue is covered by ACL obligations, we provide a remedy. 
• If not, the sale remains final.

 6.2 Marketplace Disputes (User-to-User)

• MJSTK does not intervene in disputes between buyers and sellers on the community hub. 
• Users are encouraged to: 
• Document communications 
• Provide transaction screenshots 
• Use tracked postage 
• Resolve the matter directly
   

6.3 Escalation

• If a genuine dispute cannot be resolved:
• For MJSTK-related issues: NSW Fair Trading or appropriate tribunal may be contacted. 
• For user-to-user issues: we may issue guidance but bear no liability.
